Wal-Mart has been hit with a lawsuit claiming the giant retailer was negligent when one of its truck drivers slammed into the rear of Comedien Tracy Morgan’s limousine van.
It happened in the early morning of June 7th on the New Jersey Turnpike when Morgan was returning to New York from doing a show in Delaware.
Morgan, the 45 year-old former star of “30 Rock” and “Saturday Night Live” suffered broken ribs and a broken leg in the crash. He was released from a rehabilitation facility on Saturday. He’ll coninue his recovery at home with what’s described as an aggressive outpatient program.
The lawsuit contends that Wal-Mart should have known the truck driver was awake for over 24 hours, and it alleges he fell asleep at the wheel.
The 35 year old truck driver has pleaded not guilty to criminal charges in the case,
The accident claimed the life of Morgan’s friend, fellow comedian, 62 year-old Jimmy Mack, and injured three others who were also in the limo van.
