Lawyers for Flair Airlines have filed a $50-million lawsuit in Ontario Superior Court against several plane-leasing companies over the seizure last weekend of four of its aircraft.

The filings allege that Airborne Capital and three affiliated leasing corporations “secretly” found a better deal for the Boeing 7-3-7 Maxes with a third party and then “set Flair up” for default.

The airline’s CEO Stephen Jones says Flair was not given notice, preventing it from alerting or rebooking affected customers.

A statement of claim by Flair says representatives with the leasing companies arrived at airports in Toronto, Edmonton and Waterloo early Saturday morning to confiscate the registration certificates and technical logs on board.

Earlier this week, a statement from the leasing company that seized the planes says Flair “regularly” missed payments over the past five months.

Jones told reporters Monday the company is now 100 percent caught up financially after being “a few days in arrears” with about one-million-dollars owing on the jetliners.
