QUEBEC WAITER COULD FACE CRIMINAL CHARGES AFTER ALLERGIC DINER SUFFERS LIFE THREATENING REACTION

It appears to be the first case of its kind in Canada.

A Quebec waiter who served salmon to a man with a severe seafood allergy could face criminal charges.

Police in Sherbrooke have arrested the 22 year old waiter after a customer went into anaphylactic shock back in May, and had to be hospitalized after eating at Le Tapageur restaurant.

According to police, Simon-Pierre Canuel notified the waiter from the time he was seated about his allergies. He placed an order for beef tartare, but what was served was actually salmon tartare. Within moments, he felt a reaction coming on but his life saving epipen was in the car. Police say the patron had trouble breathing and lost consciousness. He was rushed to hospital where he was in a coma for two days of a five day stay. Since recovering, Canuel says he’s tried to contact the restaurant twice with no response. So in July, he went to police with a formal complaint and is also considering civil action.

The waiter has been released from police custody with a promise to appear in court if charges are laid. Crown prosecutors are expected to make a decision in the next week or so.
